Mason Baggott & Garton Partner, Emma Jane Johns, offers some advice on recent probate issues
The Government’s most recent proposed changes to Probate fees have been delayed.
The changes would have seen the removal of the flat fee of £215 (£155 if the probate application is through a solicitor) and the imposition of banded fees based on the value of an estate.
The proposed bands would have ranged from £250 for estates worth £50,000-£300,000 to £6,000 for estates worth more than £2 million. No fee would have been payable when applying for Probate on estates with a value of up to £50,000.
There has been opposition to the proposed changes to Probate fees, with some commentators calling them a “stealth tax”. However, as proposals to change Probate fees have been on the table for some time, it will be interesting to see how quickly parliamentary time will allow for the proposals to be reintroduced.
