A senior judge from the Court of Protection has highlighted the risk of abuse by attorneys acting under a Lasting Power of Attorney. The granting of a power of attorney allows another person to make decisions for you and to conduct your affairs. Whilst the government has been keen to encourage people to make their own Powers of Attorney, the concerning evidence of an increase in the abuse of power might suggest that taking advice before proceeding could be a useful safeguard.
